1. Website use

Deliverables, fees, timelines, responsibilities, support and payment terms are set out in the proposal, order form or agreement accepted by the customer. That accepted document takes priority if it conflicts with these website terms.

3. Customer responsibilities

Customers are responsible for their content, contact lists, notices, consent, legal basis and campaign instructions. Use of WhatsApp, Google RCS, email services and AWS must comply with current provider policies and applicable laws.

4. Pricing and third-party charges

Quotes may separate NY Digital fees from Meta, Google, AWS, email-platform, carrier or other third-party usage charges. Third-party prices and policies may change independently.

5. Intellectual property

NY Digital retains rights in its platform, code, methods, documentation and website content unless a signed agreement states otherwise. Customers retain rights in the data and materials they provide.

6. Availability and liability

We aim to provide reliable services, but third-party platforms and networks can change or experience interruptions outside our control. Warranties, service levels and liability for paid services are governed by the applicable agreement and Indian law.
